La conducta se justifica cuando se comete:

1.

Por fuerza mayor o caso fortuito.

2.

En estricto cumplimiento de un deber legal.

3.

En cumplimiento de orden legítima de autoridad competente emitida con las formalidades legales.

4.

Con la convicción errada e invencible de que su conducta no constituye falta disciplinaria.
