Si del estudio preliminar, a que hace referencia el artículo 1°. de esta Ley, resultare que la bahía de Málaga no puede adaptarse como puerto que supere al de Buenaventura, con un costo igual o inferior al que este último haya de requerir para su adaptabilidad a las necesidades del comercio y de la civilización, se prescindirá de llevar a cabo el estudio formal de la bahía de Málaga, ordenado por el artículo 1°. de la Ley II de 1916, y en este caso se procederá por el Gobierno a acometer las obras que se requieran en Buenaventura para acondicionar este puerto a las necesidades del comercio y de la navegación
