Los cargos del orden judicial y los del Ministerio Publico no son acumulables, y son incompatibles con el ejercicio de cualquier otro cargo retribuido que no sea el del profesor en un establecimiento de instrucción pública. Dichos cargos son igualmente incompatibles con toda participación en el ejercicio de la abogacía.

Los empleos del Poder Judicial son de voluntaria aceptación tanto para los empleados principales como para los suplentes. Las excusas se deciden por quien hace el nombramiento.
