Si entre los comuneros hay desacuerdo acerca del derecho que tenga el constructor de habitaciones o ejecutor de otras labores o mejoras, el punto se somete a la previa decisión del Juez, mediante una articulación.

La parte que no se conforme con el fallo puede pedir su revisión en juicio ordinario y demandar el pago del perjuicio que sufra.
