El que fue delegado por alguien que se creía deudor i no lo era, no es obligado al acreedor, i si paga en el concepto de ser verdadera la deuda, se halla para con el delegante en el mismo caso que si la deuda hubiera sido verdadera, quedando a salvo su derecho al delegante para la restitución de lo indebidamente pagado.
