Contestado el traslado por el Agente del Ministerio Público, o cerrada la instrucción cuando no fuere necesario correr aquel traslado, corresponde al juez calificar el mérito del sumario, lo que hará por medio del auto de proceder o del de sobreseimiento, que deberá dictar en el término de treinta días.
