ARTICULO 42 . COMPETENCIA PRIVATIVA. Cuando la falta disciplinaria consista en incremento patrimonial no justificado, la competencia para investigar será privativa de la Procuraduría General de la Nación. Cuando ésta en uso de sus atribuciones constitucionales y legales estime pertinente avocar el conocimiento de cualquier investigación, el competente investigador del Inpec suspenderá la actuación en el estado en que se encuentre y la enviará a la Procuraduría General de la Nación.
