Examen preliminar. Recibido el expediente por el Superior, antes de iniciar el trámite, observará si la resolución apelada reune las formalidades y requisitos legales que le son propios. Si los reuniere, ordenará la tramitación del recurso. En caso contrario, mediante auto de sustanciación, la declarará inexistente y ordenará que se rehaga.
