En el caso de que la finca hipotecada o gravada con censo esté en poder de un poseedor distinto del demandado, se le notificará también el auto ejecutivo, y se le considerará como ejecutado hasta concurrencia del valor de la finca y anexos a que se extienda la hipoteca. El ejecutante designará bajo su responsabilidad el tercer poseedor de que trata este artículo.
