Practicadas por el funcionario de instrucción las diligencias conducentes al esclarecimiento de la verdad de los hechos a que se refiere el artículo 35, lo que debe cumplirse dentro del término señalado en el artículo 34 de este Código, debe pasar el sumario, junto con los instrumentos el delito, si los hay, al Juez respectivo. Transcurrido este término sin que el funcionario de instrucción cumpla dicha obligación, el Juez lo debe reclamar con el apercibimiento de multas sucesivas hasta de cincuenta pesos, que el mismo impone, si no es obedecido.
