De conformidad con el artículo 21 de la Ley 715 de 2001, las entidades territoriales certificadas no pueden crear en ningún caso prestaciones o bonificaciones con cargo a recursos del Sistema General de Participaciones. Cualquier decisión de este tipo deberá ser atendida con recursos propios de libre disposición de la entidad territorial. (Decreto 3940 de 2007, artículos 11).
