El mutuante deberá indemnizar los daños que por los vicios ocultos o la mala calidad de la cosa mutuada sufra el mutuario, si éste los ha ignorado o podido ignorar sin su culpa.
Cuando el mutuo se estipule sin intereses, el mutuante sólo estará obligado a la indemnización indicada si teniendo conocimiento de la mala calidad o vicios ocultos de la cosa mutuada, no haya advertido de ellos al mutuario.
