° El empresario o propietario naviero deberá hacer constar en el instrumento público los créditos privilegiados o especiales que en el momento de la dejación estén afectando o puedan afectar la nave; pero antes del otorgamiento de aquel deberá haber notificado de ello, a lo menos con quince (15) días de anticipación, y por escrito, al Ministerio de Obras Públicas.
