El Consejo de Estado conoce privativamente y en una sola instancia de los juicios contra las elecciones de Presidente de la República, Senadores y Representantes a la Cámara.

Igualmente conoce de los juicios que se susciten con motivo de las elecciones o nombramientos hechos por el Congreso, las Cámaras, la Corte Suprema de Justicia, el Gobierno o por cualquiera autoridad, funcionario o corporación del orden nacional.
