Para formular acusación y para dictar auto de proceder es necesario que en el proceso aparezca plenamente probado el hecho previsto como delito y al menos declaración de testigo que ofrezca serios motivos de credibilidad o indicio grave que el sindicado ha obrado dolosa o culposamente como autor o como cómplice.
