Ejecutoriado el auto de citación para sentencia, lo cual se verifica desde el día siguiente a su notificación, tiene el sustanciador diez días para formular proyecto de sentencia. Pasado este plazo el Presidente del Tribunal lo requerirá e informará de la demora al superior, el cual podrá declarar la vacancia del cargo, si ante él no se justifica la demora,
