Para los efectos del artículo 41 del Decreto 98 de 1973, en caso de que por sentencia judicial definitiva se decide que el trabajador ha perdido el derecho de cesantía por cualquiera de las causales previstas en el Código Sustantivo del Trabajo, el Fondo Regional correspondiente restituirá al empleador las sumas que por tal concepto tenga en su poder.
