Cuando se compruebe que el empresario está empleando los elementos introducidos al amparo de lo establecido en el artículo 55 de la Ley 1ª de 1959, con fines distintos para los cuales fueron importados, se harán efectivas las garantías constituidas, sin perjuicio de la acción penal aduanera por la introducción ilegal de mercancías.
