Art. 109. El Consejo de Estado no ejercerá funciones de Tribunal contencioso-administrativo, mientras no se establezca expresamente esta jurisdicción. La Ley que la establezca creará la sección de lo contencioso administrativo, y dará las reglas de procedimiento que ha de observar el Consejo cuando se constituya en Tribunal.
