En aquellas empresas en donde existan sindicatos solo se podrán suscribir convenciones colectivas.

Parágrafo

La existencia del Sindicato se entiende desde el momento de la notificación al patrono, prevista en el artículo 363 del Código Sustantivo del Trabajo.
