Mientras exista el edificio, ninguno de los copropietarios podrá pedir la división del suelo y de los demás bienes comunes.

Si el edificio se destruyera en su totalidad o se deteriorara en una proporción que represente, a lo menos, las tres cuartas partes de su valor, o se ordenare su demolición de conformidad con el artículo 988 del Código Civil, cualquiera de los copropietarios podrá pedir la división de dichos bienes.
