Ámbito de protección. Para los efectos de este decreto, considérese el territorio nacional como un área de potencial riqueza en materia de patrimonio arqueológico. Sin perjuicio de lo anterior, las Áreas Arqueológicas Protegidas deberán ser previamente declaradas por la autoridad competente. En ningún caso la inexistencia de la declaratoria de un Área Arqueológica Protegida o la inexistencia de un plan de manejo arqueológico, faculta la realización de alguna clase de exploración o excavación arqueológica sin la previa autorización del Instituto Colombiano de Antropología e Historia, en adelante ICANH.
