Prohíbese detener a ninguna de las personas de que tratan los dos artículos anteriores en parte alguna distinta de las fijadas en ellos. La violación de esta prohibición hará Incurrir al funcionario de instrucción o Juez y al alcalde o jefe del respectivo establecimiento, en la pérdida del empleo y en la interdicción del ejercicio de derechos y funciones públicas durante un año, sanción que les será impuesta por el superior respectivo, sumariamente, con la sola vista de la prueba de que se ha incurrido en la infracción.
