º Las vacantes a que se refiere el artículo 19 del Decreto número 1325 de 1932, son aquellas que se produzcan transitoriamente en puestos que se encuentran en actividad, es decir, mientras se provee el reemplazo. El no funcionamiento de un puesto, por haberse resuelto dejarlo indefinidamente acéfalo, aunque haya estado antes en actividad, o por no haberse organizado las unidades que completan la dotación que debe tener el Ejército, o por estar servido por un Oficial de menor grado, no se considera como vacante para los efectos de dicha disposición.
