Los salarios mínimos sustituyen de derecho, durante su vigencia, cualesquiera otros inferiores que se hayan estipulado o se estipulen. A falta de prueba del salario estipulado en cada caso, las condenas a que haya lugar en las controversias laborales, se calcularán sobre el que se señale por peritos designados oficiosamente por el Juez, sin bajar del respectivo mínimo.
