El artículo 289 del Decreto 2666 de 1984, quedará así: “Efectividad de las garantías. Declarado el incumplimiento de la obligación y ejecutoriado el acto sin que se haya efectuado el pago, el Administrador de Aduana o el funcionario ante quien se haya otorgado la garantía dará traslado a la jurisdicción coactiva para que proceda a hacerla efectiva. Contra el acto que declare el incumplimiento de una obligación solo procederá el recurso de reposición ante el mismo funcionario”.
