° Para poder prestar el servicio público de transporte municipal, toda empresa de transporte constituida ya sea por persona jurídica o natural, deberá obtener previamente una licencia de funcionamiento, expedida por la autoridad competente metropolitana, municipal o del Distrito Especial de Bogotá.
