º El decomiso precautelar se practicará cuando se tema fundadamente que va a llevarse a cabo una futura exportación ilegal de bienes que tengan el carácter de monumentos muebles. En este caso el decomiso se efectuará mediante orden escrita del Director General de Aduanas, quien sólo puede impartirla previa apreciación de los medios de prueba previstos en las Leyes, de conformidad con las reglas de la sana crítica.
