Sobre un mismo punto no puede pedirse dictamen de peritos sino una sola vez en cada instancia del juicio.

Parágrafo

Para que en la segunda instancia se admita un nuevo dictamen pericial, se requiere la comprobación del error, de la incapacidad o incompetencia de quienes rindieron dictamen pericial en la primera instancia.
