Los comandantes de buques de guerra, unidades aéreas o aeronaves militares, en tiempo de guerra o conflicto armado, podrán imponer en el acto mismo, las penas de que trata este código sin juicio previo, para contener una insubordinación o motín a bordo; y en tiempo de paz, cuando no se hallen en puerto o aeropuerto colombiano.
