Presentación del desistimiento, costas y apelación. El escrito de desistimiento deberá presentarse personalmente en la forma indicada para la demanda. Siempre que se acepte un desistimiento se condenará en costas a quien desistió, salvo que las partes convengan otra cosa o que se trate del desistimiento de un recurso ante el juez que lo haya concedido. ' El auto que resuelva sobre el desistimiento de la demanda es apelable en el efecto suspensivo.
