- Transmisión de la pensión . Cuando fallezca el pensionado por invalidez, jubilación o retiro por vejez, su cónyuge y sus hijos menores de diez y ocho (18) años o incapacitados para trabajar por razón de estudios o por invalidez, que dependieren económicamente del causante, tendrán derecho a percibir la respectiva pensión durante los dos (2) años subsiguientes al fallecimiento del pensionado.
