El que sin permiso de la autoridad cultive o destruya, venda o suministre, aun cuando sea gratuitamente, use o tenga en su poder la marihuana (canavis sativa y cannabis indica), incurrirá en relegación en la colonia agrícola de dos (2) a cinco (5) años. Cuando el que use la marihuana requiera tratamiento especial en casa de reposo u hospital a juicio de los médicos legistas, se impondrá como única medida, internación en establecimiento adecuado por el tiempo necesario para su curación.
