El artículo 1837 del Código Civil quedará así: Los cónyuges incapaces y sus herederos en el mismo caso, solo podrán renunciar a los gananciales con autorización judicial. Lo dicho en los artículos 1838, 1840 y 1841 se aplicará tanto al marido como a la mujer.
