ART. 1423. El legatario que en virtud de una hipoteca o prenda sobre la especie legada, ha pagado una deuda hereditaria con que el testador no haya espresamente querido gravarle, es subrogado por la lei en la acción del acreedor contra los herederos.

Si la hipoteca o prenda ha sido accesoria a la obligación de otra persona que el testador mismo, el legatario no tendrá acción contra los herederos.
