Art. 45. El remate se asegurará á satisfacción de la Junta que lo presida con hipoteca de finca raiz ó prenda, libres de todo gravamen anterior y cuyo valor sea doble del que, según el remate, haya de producir la renta en un trimestre ; ó bien con fianza personal presentada por individuos de reconocida solvencia y que tengan bienes propios en el Departamento.
