El producido del impuesto de que trata el artículo 4o. de esta Ley se distribuirá así: un sesenta por ciento (60%) ingresará al Fondo Nacional del Carbón y el cuarenta por ciento (40%) restante corresponderá por mitades a los Departamentos y Municipios en cuyo territorio se adelante la explotación. La inversión de este recurso será exclusivamente con los fines previstos en el artículo 6o. del Decreto 1245 de 1974.

Parágrafo

El Fondo Nacional del Carbón entregará a los Municipios y Departamentos el producto de este impuesto por trimestres vencidos.
