La pena de separación del servicio consiste en el retiro del Ejército.
El condenado a esta pena conservará su derecho a pensión de acuerdo con las leyes y reglamentos militares, pero tal derecho se hará efectivo únicamente desde cuando se hubiere cumplido la pena principal.
