ARTICULO 38 . EL FACTOR TERRITORIAL. Es competente para ordenar la investigación disciplinaria el Director General, el Director Regional o el Director del Centro de Reclusión del territorio donde se realizó la conducta, salvo que el transgresor sea de mayor jerarquía caso en el cual se remitirá lo actuado al superior jerárquico del investigado para que disponga lo pertinente. Si la investigación cursa en la Procuraduría General de la Nación, la competencia se determinará de conformidad con lo previsto en las leyes orgánica y reglamentaria de esa entidad.
