Se eximirá de toda pena al responsable del delito de que trata elArtículo 186, cuando retracte su declaración antes de que se cierre la instrucción sumaria por auto de proceder o de sobreseimiento.

Si la retractación se hace en una época posterior a la dicha, o se refiere a una declaración falsa en materia civil, la pena se reducirá de la tercera parte a la mitad, siempre que se haga antes del veredicto del Jurado, en los asuntos en que éste interviene o antes de la sentencia en los demás.
