El que provoque, contamine o realice directa o indirectamente en los recursos de agua, suelo, subsuelo o atmósfera, con ocasión a la extracción o excavación, exploración, construcción y montaje, explotación, beneficio, transformación, transporte de la actividad minera o de hidrocarburos, incurrirá en prisión de cinco (5) a diez (10) años, y multa de treinta mil (30.000) a cincuenta mil (50.000) salarios mínimos legales mensuales vigentes.
