Cuando en el proceso aparezca plenamente comprobado el cuerpo del delito y resultare, por lo menos, una declaración de testigo que ofrezca serios motivos de credibilidad conforme a las reglas de la crítica del testimonio o graves indicios de que el procesado es responsable penalmente, como autor o partícipe del hecho que se investiga, el Juez dictará auto de proceder.
