Las expropiaciones a que haya lugar para el establecimiento del monopolio de la industria de los fósforos que se decretan en esta Ley, deberán hacerse previamente, de acuerdo con la Constitución.

Dichas expropiaciones a los arreglos privados a que haya lugar, deberán ventilarse o celebrarse, según el caso, con los dueños de las fábricas, y si se trata de compañías anónimas, con quien represente por lo menos el sesenta y cinco por ciento (75 por 100) de las acciones suscritas.
