Es obligado a prestar fianza a peticion del acreedor,

1.º El deudor que lo haya estipulado;

2.º El deudor cuyas facultades disminuyan en términos de poner en peligro manifiesto el cumplimiento de su obligacion;

3.º El deudor de quien haya motivo de temer que se ausente del Territorio, con ánimo de establecerse en otra parte, miéntras no deje bienes suficientes para la seguridad de sus obligaciones.
