Las penas señaladas en este capítulo podrán reducirse hasta la mitad, sin que sean inferiores en ningún caso a las que determina el Código Penal para las correspondientes infracciones entre particulares:

Si los delitos de que se trata se cometieren en tiempo de paz; y

Si se comprobare que el inferior ignoraba en absoluto la calidad del superior ofendido.

Para la prueba de esta ignorancia no basta el hecho de que el superior no haya llevado en el momento de la infracción el uniforme o las; insignias de su calidad o mando militar.
