Los padres, el cónyuge y los hijos menores del empleado retirado con pensión de jubilación por haber completado el tiempo de servicio previsto en la Ley, que fallezca sin haber disfrutado de la pensión durante tres años, tendrán derecho a percibirla durante un año, siempre que comprueben que carecen de lo necesario para su congrua subsistencia y que vivían a costa del pensionista al tiempo de la muerte de éste.
