Si existiendo de parte del agente el propósito de matar, la muerte no se produce sino por el concurso de un hecho subsiguiente dependiente de la actividad de la víctima, o de un tercero, la sanción de que tratan los artículos anteriores, puede ser disminuida hasta una tercera parte.
