Es presunción legal de responsabilidad en los delitos de falsificación o alteración de moneda el ser el sindicado, a sabiendas, poseedor o mero tenedor de máquinas o instrumentos adecuados para la fabricación de la moneda, siempre que, por otra parte, conste que en poder de la misma persona han existido recientemente monedas falsas.
