El comandante de un buque, aeronave, carro de combate o medio de transporte colectivo de la fuerza pública que después de haber agotado los recursos para defenderlo o salvar a los tripulantes, no lo inutilice o destruya para impedir que caiga en poder del enemigo, incurrirá en prisión de tres (3) a seis (6) años.
