El que quiera ejercer una industria, comercio o ramo de negocios ya explotados por otra persona, con el mismo nombre o la misma designación comercial, adoptara una modificación sustancial, haciendo que sea clara y visiblemente distinta de la que usare la casa o establecimiento preexistente, y que evite toda confusión que a primera vista pudiere producirse.
